1. Scope
This Markvox Service Addendum ("Addendum") supplements the Nimvox Terms of Service ("Terms"). It governs your use of Markvox, Nimvox's end-to-end brand creation platform.
In the event of a conflict between this Addendum and the main Terms, this Addendum governs for Markvox-specific matters. All other provisions of the main Terms remain in full force and effect.
2. Definitions
In addition to the definitions in the main Terms, the following terms apply to Markvox:
"Brand Project" means a single branding initiative within Markvox, containing name candidates, domain checks, design assets, and review sessions.
"Organization" means a multi-tenant workspace in Markvox where users collaborate on Brand Projects.
"Design Asset" means an SVG file (logo, wordmark, icon, lockup, or other brand visual) uploaded to or generated within Markvox.
"Review Session" means a structured evaluation of Design Assets by Organization members, using simple (1-5 star) or full (4-dimension) scoring.
"Brand Guide" means the PDF document generated by Markvox containing logo usage guidelines, color specifications, and typography information.
"Pipeline" means the six-stage brand creation workflow: Naming, Domain Check, Trademark Screening, Design, Review, and Distribution. The Trademark Screening stage is a placeholder for tracking your own progress; as stated in Section 7, Markvox performs no trademark search.
3. Platform Service Description
Markvox is an end-to-end brand creation platform that provides the following capabilities:
Name Generation: Create, track, and evaluate brand name candidates with structured status tracking (active/rejected/approved).
Domain Availability: Automated registry lookups across .com, .dev, and .app top-level domains. Availability is determined by querying each extension's registry, and a registry that publishes no lookup service returns an explicit "unknown" rather than an availability answer.
Design Tools: SVG upload with auto-detection of asset type and variant, wordmark generation, version tracking, and comparison views.
Executive Review: Structured review sessions with simple (1-5 star) or full 4-dimension scoring (brand, UI/UX, typography, marketing) and decision logging.
Asset Distribution: ZIP download of approved assets organized by type, and PDF brand guide export with color specifications.
4. Multi-Tenancy & Organization Isolation
Each Markvox Organization is logically isolated. You acknowledge and agree that:
There is no cross-Organization data access — Brand Projects, Design Assets, and Review Sessions from one Organization cannot be accessed by another
Organization owners control member invites and role assignments (owner, admin, member, viewer)
You are responsible for managing access to your Organization and the brand assets within it
Nimvox is not responsible for unauthorized access resulting from shared invite links or compromised credentials
5. Intellectual Property & Brand Assets
You retain all intellectual property rights in the brand names, logos, and design assets you create or upload to Markvox. Specifically:
Your content, your rights: Nimvox claims no ownership of your brand names, Design Assets, Brand Guides, or any other creative content you produce using Markvox
Limited license to Nimvox: You grant Nimvox a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Markvox service
No use beyond the service: Nimvox will not use your brand assets for marketing, training, or any other purpose without your explicit written consent
Export at any time: You may download all your Design Assets as ZIP packages and Brand Guides as PDFs at any time during your subscription
Deletion on termination: Upon account deletion or subscription termination, your data will be deleted in accordance with the retention periods described in the main Terms
6. AI-Generated Material
Markvox uses artificial intelligence to produce material you ask it for — brand name
suggestions, and logo drafts. That material (“AI
Output”) is covered by Section 5 above like any other content you
create with Markvox, and by the following terms, which apply specifically to it.
Nimvox claims nothing in it. To the extent Nimvox
holds or could hold any right in AI Output generated for you, we assign it to you. We do
not use it for our own purposes, and we do not resell it.
Copyright in AI Output may be limited, and this is the
important one. In the United States and several other jurisdictions, material
generated by a machine without sufficient human authorship may not be protected by
copyright at all. This is a feature of the law, not of Markvox, and it applies to AI
Output however it is produced. Practically: a logo you take from Markvox and then
meaningfully edit, arrange, or combine with your own work is more likely to be
protectable than one you publish untouched, and a name is generally protected as a
trademark through use and registration rather than by copyright. Nimvox does not
represent that AI Output is protectable, and you should not assume that it is. If it
matters to your brand, take advice before you rely on it.
AI Output is not unique. Two customers who ask for
something similar may receive similar suggestions, and a name or mark Markvox suggests may
already be in use by someone else. Markvox performs no trademark search of any
kind — see Section 7 — so a suggestion tells you nothing about whether a
name is free to use. Establishing that requires a search and, ordinarily, advice from a
qualified trademark attorney.
Your content is not used to train models. Generating
AI Output sends the brief or prompt you supply to a third-party AI provider, listed at
nimvox.dev/sub-processors.
We contract with those providers so that your content is not used to train their models.
A provider may retain input for a limited period for its own abuse monitoring; where that
applies, the period is stated on that page.
AI features run only when you use them. Nothing is
sent to an AI provider in the background, and no account or billing data is sent to one at
any time.
Accuracy. AI Output may be inaccurate, unsuitable,
or unfit for your purpose. It is a starting point for your judgement, not a substitute for
it, and it is provided without warranty of any kind.
7. Domain Availability Checks
Markvox provides automated domain availability checks as a convenience tool. You acknowledge and agree that:
Markvox does not search trademark registers: Markvox performs no trademark search of any kind, and no result it displays should be read as indicating that a name is free of conflicting trademarks. Determining whether a name is available to use as a brand requires a trademark search and, ordinarily, advice from a qualified trademark attorney — neither of which Markvox provides
Not legal advice: Nothing Markvox displays or generates is legal advice, and no attorney-client relationship arises from your use of it
Some extensions cannot be answered: Availability is determined by querying the registry for each extension. Some registries publish no lookup service, and for those Markvox reports an explicit "unknown" rather than an availability answer. An "unknown" result means the check could not be completed — it does not mean the domain is free
No guarantee of accuracy: Results depend on third-party registry services that may be incomplete, delayed, or temporarily unavailable. Nimvox does not guarantee the accuracy or completeness of results
Checks are point-in-time: Results reflect status at the moment of the check. Domain availability may change at any moment, and only a registrar can confirm a domain at the point of purchase
No filing or registration service: Markvox does not register domains or file trademark applications on your behalf
Your responsibility: You are solely responsible for conducting thorough due diligence before adopting any brand name, including trademark searches, which Markvox does not perform
8. Storage & Asset Management
Design Assets are stored using Nimvox's storage infrastructure (local or S3-compatible cloud storage). You acknowledge that:
Storage limits are enforced per Organization based on your subscription tier
Only SVG files up to 512KB per file are supported for upload
Nimvox maintains reasonable backups but does not guarantee against data loss. You are encouraged to maintain your own copies of important Design Assets
Uploaded assets are validated for file type but not scanned for malicious content. You are responsible for ensuring uploaded files do not contain harmful code
9. Service Tiers & Billing

No refunds are provided for partial months
If you exceed your tier's limits, you will be prompted to upgrade. Existing data is not deleted when downgrading, but new creation may be restricted
Pricing may change with 30 days' notice as described in the main Terms
10. Data Processing & Privacy
Nimvox processes your data in Markvox as follows:
Account data: Email, name, and hashed password (bcrypt cost 12) are stored for authentication
Brand data: Name candidates, domain check results, Design Assets (SVGs), review scores, and distribution records are stored within your Organization
Billing data: Subscription status and plan tier are stored. Payment details are handled entirely by Stripe and PayPal — credit card data never touches Nimvox servers
Sessions: JWT tokens stored in httpOnly, Secure, SameSite cookies with 7-day expiry
Data export: You may export your data at any time via ZIP download (Design Assets) and PDF export (Brand Guides). A comprehensive data export facility for GDPR portability requests is available by contacting support
